SHAYANNA JENKINS-HERNANDEZ’S $10K TRUST FUND REQUEST FOR DAUGHTER IS DENIED BY TRUSTEE

Shayanna Jenkins-Hernandez’s $10,000 dollar trust fund request for her ten-year-old daughter has been denied by trustee David Schwartz.

According to the 33-year-old mother of two, David Schwartz is not releasing a $10K reimbursement to her from the trust fund, set up by her late fiance’s New England Patriot, Aaron Hernandez’s estate for their daughter Avielle. Jenkins-Hernandez claims that she is due the reimbursement as a result of expenses for her daughter’s competitive dance.

“Since Aaron’s death, my sole focus has been on raising and providing as stable a life for my children as possible,” Jenkins-Hernandez said in an e-mail to the Boston Globe. “All monies I have spent have been with this singular focus in mind, and this will continue to be my focus going forward.”

On the other hand, trustee David Schwartz argues that fees for Avielle’s dance should have been covered in separate funds that Jenkins-Hernandez receives a part from the trust. Schwartz wrote in a court filing, “Accountings do not demonstrate how such spending has all been for Avielle’s benefit or why she has not been able to preserve from that large sum the much lower cost of this dance school tuition.”

The filing continues stating that Jenkins-Hernandez has, “provided no facts on which such relief could be granted. There is every reason to question whether and how the Conservator is applying the significant resources that should be available to pay for Avielle’s daily needs, including dance lessons, especially since all of her basic housing security and educational expenses are paid from the Trust.”

Schwartz stated that Jenkins-Hernandez receives approximately $150,000 yearly to cover Avielle’s daily expenses. The trustee also made the request to have Jenkins-Hernandez removed as conservator.

If you remember, the former New England Patriots tight end was arrested in 2013 for the murder of Odin Lloyd. Hernandez was convicted in 2017 and sentenced to life in prison. He was later found dead in his jail cell as a result of suicide.
