Naya Rivera’s ex-husband, Ryan Dorsey, has filed a wrongful death lawsuit on behalf of their son, Josey Dorsey. Ryan filed documents in his son’s name with the Ventura County court system on Tuesday (Nov. 17).
According to PEOPLE,
“Josey is suing Ventura County, California — where Rivera accidentally drowned during a boat excursion with her son at Lake Piru in July — the county’s Parks and Recreation Management, and the United Water Conservation District for wrongful death and negligent infliction of emotional distress.
Dorsey and Rivera’s estate filed the paperwork on Tuesday. The lawsuit claims Rivera’s death was preventable and states that the boat she and her son rented from Lake Piru did not have the proper features and equipment necessary to comply with U.S. Coast Guard safety standards.”
Naya Rivera and Josey went for a swim on July 8, 2020. The GLEE star rented a boat upon her arrival to Lake Piru, which she used to explore the small body of water. Attendants became alarmed when Naya did not return the boat before closing, which is why one of the employees searched the lake for the actress and her son.
Josey was discovered resting on the boat while Naya was nowhere in sight. The toddler told the boat attendant that his mom went for a swim but never came back up. Naya Rivera’s body was discovered in the lake days after her initial disappearance. Drowning was named as the reason for her death.
“Naya was an amazing talent but was an even greater person, mother, daughter, and sister,” Rivera’s family said in a statement after search efforts by Ventura County concluded. “Heaven gained our sassy angel,” the family said.
