A judge has ruled that Gabriel Aubry must have a nanny present at all times when he is with his daughter Nahla Aubry,3.

A Los Angeles judge has refused Aubry’s request to rescind a requirement that a nanny be present whenever he has custody of Nahla while the two are in Europe, according to TMZ. Aubry is currently in Spain taking care of Nahla while Berry is filming Cloud Atlas in Majorca.

He is allowed three hours alone with the child and can take her to a park or shopping, but the court upheld the order that a nanny must be present at all other times, including overnight stays.
Aubry feels the nanny is encroaching on his relationship with Nahla, according to Radar, and furious that his every move with Nahla being supervised. Berry, meanwhile, is regularly seen with her new boyfriend, Olivier Martinez.
Berry, 45, and Canadian model Aubry have been embroiled in a bitter and long-running court fight over custody of their daughter that began soon after their split in the spring of 2010 following five years together.
Aubry has been accused of neglect and verbal abuse of Nahla, according to witnesses cited by Berry in court papers obtained by The Star earlier this month.
