Halle Berry has temporarily lost 50-50 custody of her 12-year-old son, Maceo, amid her ongoing legal battle with ex-husband Olivier Martinez.

A judge granted the French actor temporary primary custody of Maceo on Thursday after he filed for a restraining order against Berry and accused her of physically abusing their son.
The actress is still allowed to spend time with Maceo without supervision, but her parenting time has been reduced to two days a week and every other weekend. She has also been ordered to stay at least 100 yards away from Martinez.
The ruling comes just days after an alleged Sept. 26 confrontation between the Oscar winner and her son.
As previously reported, Martinez claims Maceo was playing a virtual reality game when an argument with his mother turned physical. He alleges Berry put her hands around the 12-year-old’s neck and choked him.
Maceo later contacted his father and asked to be picked up.
Martinez claims the incident wasn’t the first time his ex-wife has physically and emotionally mistreating their son and is now seeking sole legal and physical custody.

Berry is pushing back against the allegations.
“To say this filing is entirely meritless and deliberately misleading would be an understatement,” her attorney, Marina Beck, told TMZ.
Beck pointed to previous court rulings involving the actor, claiming he repeatedly violated court orders and interfered with therapeutic and educational services for Maceo. She noted that he has previously been sanctioned by the court over some of that conduct.
The attorney also accused Oliver Martinez of having a history of “erratic, possessive and violent behavior” and said Berry would continue “fighting for Maceo’s best interests.”
The former couple has been at odds over their son’s care for years. In 2024, the mom of two sought sole legal custody of Maceo, accusing Martinez of refusing to cooperate with decisions involving their son’s education, health and therapy.
That same year, the pair were ordered to participate in co-parenting therapy in an effort to improve communication surrounding Maceo.

Berry and Martinez married in 2013 and welcomed their son that October. They announced their separation in 2015, but their divorce was not finalized until 2023.
Under their divorce agreement, they shared joint legal and physical custody of Maceo.
Berry is also mom to 18-year-old daughter Nahla, whom she shares with ex-boyfriend Gabriel Aubry.
For now, the change to Berry’s parenting time is temporary. The exes have been ordered to participate in confidential mediation and are due back in court on Oct. 16.
